We collect some of the most frequently asked questions that may be of help to you.
It is important to make a will before any illness or accident occurs. If it does not exist, the law will decide for us about the destination of our assets. The will is always revocable by the grantor and is only activated at the time of the death of the signatory.
Leaving a joint legacy does not in any case mean harming the legitimate heirs since common law protects them as heirs. Thus, an inheritance is divided in the following way:
- The third of legitimate: is distributed between sons and daughters equally.
- The improvement third: the testator has certain availability regarding this part when awarding it. It must also be distributed among the offspring but not necessarily in equal parts.
- The freely available third: the testator can leave it to whoever he wants, whether family member or not, and may be a legal entity. You can decide on this part with absolute freedom. And, if you wish, leave a Solidarity Legacy to one or more NGOs. (In the case of Catalonia, Navarra, the Balearic Islands, Aragon, Galicia and part of the Basque Country, there are specific regional regulations that can change the way inheritance is distributed)
There's no need. You only need to contact your notary to make a small modification. You can change your will at any time.
Yes, the will can be changed as many times as you want throughout your life.
Yes, at ALBOAN we always respect the donor's intention and the specific wish they wish to give to any donation. However, we recommend that donations be directed towards a general wish and that the organization state the future use of the contribution, because over time the needs change and this flexibility in donations allows us to direct the funds received towards those most urgent projects.
- Tangible assets (a property, a car, a work of art, jewelry, etc.).
- Money in financial institutions (checking accounts or deposits) or metallic cash.
- Investment funds or shares.
- The heirs.
- You would note them. Both are required by law to notify and deliver legacies.
Non-profit entities are not subject to Inheritance and Donation Tax and therefore solidarity bequests are free of tax rates for the beneficiaries.
